Police Cracking Down on ATV Riders

Complaints of bikes operating on Davidson Mill Road and in the rear of the Ireland Brook development.

South Brunswick Police are conducting a crackdown on individuals riding dirt bikes and ATVs after numerous complaints about the vehicles operating in the eastern portion of town.

Residents have complained about the vehicles operating on Davidson Mill Road along high tension lines, and in the rear of the Ireland Brook development. Police are asking for voluntary compliance, but riders caught violating the law will face zero tolerance enforcement, according to police.

in an ATV accident near Davidson Mill Road. The victim was riding on an ATV trail with two friends, who were on separate ATV's, police said. The victim then came across a large puddle of water on the trail and apparently lost control of his vehicle after hitting the puddle, causing the ATV to flip over.

Violators are subject to a fine of up to $1,000 and their vehicles could be impounded. South Brunswick Township's ordinance 88-21 prohibits the use of these ATV’s and bikes. 

Sec. 88-21. - Prohibited acts. 
It shall be unlawful for any person to operate any motorized vehicle, including motorcycles, snowmobiles, mopeds, mini-bikes, trail bikes, motor scooters, go-carts, motorized skateboards, all-terrain vehicles (ATV's) and dune buggies or any other vehicle in the class known as recreational vehicles on any property or under any circumstances described in section 88-22.

Yet another liberty we take away from people. This ordinance limits the use to everyone other than emergency personnel and farmers. The ordinance sites concerns of safety and noise. If that is a concern, perhaps they should focus on limiting car and truck traffic; far noisier and more dangerous. And before you say that the town has worked to that end, they should never have allowed the large warehouses in to create the issues in the first place.

The way this is written I'm in violation in my driveway or any parking lot. "or under any circumstances described in section 88-22." What are the circumstances in section 88-22? I work from 8 A.M. to 8 P.M. so my getting down to city hall to find out is very limited.

8-22 "The property to be regulated by this article is all publicly and privately owned property on or off the improved right-of-way, including, but not limited to, all private and public highways and roadways." The SBT Municipal Code can be found online @ http://library.municode.com/index.aspx?clientId=13445 So it appears any property, public or private. I guess if you are using an ATV to plow your driveway it needs to look like a lawnmower or tractor.
