PIACS Application Close to a Final Vote
Vote on application for proposed charter school expected at next South Brunswick zoning board hearing in March.
After two applications and nearly two years of hearings before the South Brunswick Zoning Board, a vote on the proposed site of the Princeton International Academy Charter School (PIACS) is expected to occur at the next zoning hearing on March 22.
Testimony continued last night before the zoning board, as a crowd of about 100 people sat quietly as PIACS witnesses presented testimony on traffic impact, floor layout and planning for the proposed site of the charter school at 12 Perrine Road.
An estimated 170 students from the South Brunswick, Princeton, and West-Windsor-Plainsboro school districts would begin at PIACS in the first year of operation. Within four years, PIACS’ enrollment is expected to grow to 290 students in the K-5 school.
At last night's hearing, PIACS witnesses were again chided by the zoning board for failing to submit requested documents in a timely fashion.
At the previous hearing in December, PIACS engineer Elizabeth Dolan presented a traffic impact study that remained an issue at last night's hearing. After the hearing in December, zoning board engineer Frank Antisell sent additional questions to the applicant about the traffic impact PIACS would have on the Perrine Road intersection with Schalks Crossing Road.
Dolan testified that her responses to those questions were sent to Antisell on Feb. 6. However, the documents weren't received by Antisell until last week, which he said didn't provide much time for review.
One of the issues raised by Antisell was the traffic count for the intersection was performed on a day when school was not in session last June.
"You see a difference when school is in session versus when it's not in session," Antisell said during the meeting. "Right there underlines one of our biggest questions. Is the traffic you're showing here even relevant or correct? Additional counts need to be done when school is in session so we have relevant data we can rely on."
Plans for the school would require Perrine Road to be widened from 12-feet to 20-feet across the frontage of the property. Concerns remain about traffic backup from the Perrine Road-Schalks Crossing Road intersection, which is approximately 480 feet from the school entrance.
During peak hours for traffic at the intersection, close to 1,000 vehicles are projected to be on Perrine Road and Schalks Crossing Road. Projecting a 2 percent growth in traffic per year, by the fourth year of existence for PIACS there would be an additional 65 cars added to the road, with about 350 seconds of wait time at the intersection.
Dolan said going back and performing a new traffic count when school was in session wouldn't dramatically alter the outcome of the original study. As a condition for approval, the applicant would pay for an off-duty police officer to handle the traffic flow during peak hours to reduce backup.
"Additional data would do nothing more than affirm there is a problem at that intersection," she said.
Board Chairman Martin Hammer said the worst-case scenario that could arise from the additional data would be evidence that a traffic signal should be installed.
"If a traffic signal is warranted this applicant would pay its fair share," said 12 P attorney Edward Boccher. "We've already committed to pay for a police officer to regulate traffic."
Dolan said there were no studies conducted on the traffic impact to Schalks Crossing Road from an officer stopping traffic to eliminate backup on Perrine Road.
The site plan for the 44,827-square-foot building calls for 25,351-square-feet to be used for educational purposes, while the remaining space would be unused pending future expansion. The unused portion of the building would be inaccessible from the inside.
The building's current office and warehouse space are to be converted into classrooms. An 11,000-square-foot playground will also be constructed with a 4-foot high fence surrounding it.
There would be 14 classrooms, five support classrooms for art and music, four faculty offices, a reception area, a nurse's office, and 9 bathrooms. There would be no gym or cafeteria, but there would be a multi-purpose room to possibly fill those needs.
Planner John Chadwick testified on behalf of 12 P and said he didn't believe there would be any negative impact from the charter school on the surrounding area.
"In my judgment there's no question that the public benefit clearly outweighs any substantial impact that could be attached to this application," he said.
During public questioning of the applicant's witnesses, attorney Kevin Sheehan, who represents the three school districts, questioned whether an environmental impact study was ever performed on the building.
Specifically, he asked whether the building was used for industrial purposes, whether hazardous materials were ever stored at the site, and whether there were ever any discharges of hazardous materials at the site.
Boccher said such questions were beyond the jurisdiction of the zoning board and needed to be addressed by the Department of Environmental Protection.
Hammer reminded Boccher that the township ordinance requires an environmental impact study.
"The ordinance requires it and you didn't provide it," Hammer said. “When it's in the ordinance that you provide certain things, and it's still not provided, then it's a fair question. I'm surprised you're not taking the opportunity to answer it."
Boccher added that that he was concerned about prolonging a discussion on the environmental impact because it would open up a line of questioning that's inappropriate, but said the applicant would provide the necessary answers.
"I will continue to insist that items my planners ask for are provided," Hammer said. "This isn't an 11th hour request. You told us it doesn't matter, but we asked for it. So please do answer."
At the next hearing on March 22, 12 P witnesses will return to answer questions about the site plan that still need to be addressed. Sheehan said he will present two witnesses related to traffic and planning on behalf of the opposition.
There will also be an opportunity for public comment on the application.
The zoning hearing is scheduled for 7:45 p.m. on March 22 in the auditorium at the South Brunswick Senior Center.

I believe that delivering late documents is a tactic. They likely think that if documents are delivered late there will be less scrutiny. Remember that this is how they originally got the charter. Clock is ticking. If they don't get approval by June will they be done?

It is not likely that there will not be a ruling before June. The planning board has granted them a great deal of latitude. The board needs to be commended for their handling of the situation. Last evening it seemed that their claim was the updated information requested by the township engineer was not relevant or important. Think about that for a moment, you are requesting a waiver and the people responsible for granting that waiver request information and you tell them it is not important. In addition, it seemed like their attorney argued that the documents required by the township ordinance are not important because in his view they are outside the scope of the planning board. If you want to argue the ordinance is unfair and needs to be modified or removed that is a different argument for a judge to hear otherwise just comply.

It looks like it gets an infinite number of tries until it finally gets it right, someday in some far distant universe. In any case, a specialized niche charter school, which is not needed, is being forced down the throats of 3 successful, high ranking school districts, whether the residents want it or not.

I think the zoning board is handling this applicant quite fairly. I have attended all the meetings but the first one.
If I recall at the December meeting, the PIACS attorney was complaining that they could not get onto the schedule sooner than February...why did Dolan wait until February to send in her documents? If they had scheduled in January, she would not have had the time. Let's see if she gets her act together and has the newly requested studies done by March! It's plain incompetence. Or a whole lot of games.
And before you start calling me names, Mr. Winston, I am not an teacher, a member of any union, political group or affiliation. I am a satisfied mom of 2 very successful students in the SB school district. My opinions are formed based on my experiences. I am so sorry your experience with the schools was so poor. While it is impossible to make everyone happy and successful, I do believe the schools in SB strive to do their best.

I think we differ in opinion. What you call unprofessionalism and amateur antics, I call the zoning board being thorough. Thorough is fair.
The Chinese do not strike fear in me. My issues were about the organization,they wanted to open a private school along with the charter school. It was too much co- mingling of funds and services. And obviously they realized they were wrong to try to attempt the two schools together in one building because they refiled to remove the private school from the building.
Even back in November I had an issue about the traffic. You're in Kingston...I am of Raymond Rd...you know what those jug handles on Rt 1 are like during peak hours. I actually saw someone try to make the turn, cutting into the wrong side, onto oncoming traffic just last week, to beat the line waiting to make the left turn. That could have been a major accident if we all weren't paying attention.
And the jug handle at Ridge is an issue, often on mornings you will see s police officer sitting there because drivers use the shoulder.
I'd like the traffic situation be corrected to make a safe environment for the children, the seniors living in the area, emergency vehicles going to the new Princeton Medical center, and even for you!
If that makes me a xenophobe, then I guess I am. But for the record, personally, I can't stand unions. My opinions are purely selfish...I don't want unsafe and crowded traffic conditions in my town.

The US unionization rate (for all jobs) is 11.8 percent, essentially unchanged from 11.9% in 2010, the U.S. Bureau of Labor Statistics recently reported. In 1983, the union membership rate was 20.1%. There has been aggressive union busting going on for 30 years. In all too many jobs, the mere mention of a union can get you suspended and eventually fired. I am just amazed at all the anti-union sentiment in this country. Germany, Canada and Japan are very successful countries and they have unionization rates more than twice ours. So please don't hand me this garbage that unions ruin jobs or the economy.
North Carolina has the lowest unionization rate, (2.9%), because there are aggressive anti-union rules and rampant union busting.

Please do not assume that my opinion is based on propaganda. I base my opinions on my personal experiences. I have family in the NY Police Department and Fire Department, Plumbers Union, etc. I never made any specific remarks about unionization rates or economy. You are correct regarding higher taxes in that the amount of money that goes to the charters is 90% of our per pupil cost (per the law). The marginal decrease in expenses from 50 students coming off our rolls is much less than 90% of our per pupil cost, maybe as low as 5%, because they don't all come from one school or classroom.

Hey Marty maybe you need to talk to a real CPA. If 90% leaves with the child the school district retains 10% and no longer has to provide services for that child. So all the school district has to do is adjust their overhead thereby eliminated taxes. Just like people do in the real world with their personal finances...

This is a private web site. The moderators can ban any one for any reason. This has nothing to do with freedom of speech. There's nothing in the Constitution about having an unlimited right to slander people on a private web site. Winston can be banned from here, it doesn't violate his freedom of speech. There are a million other web sites where he can spout off, unless he violates the terms of use rules. Most web sites have terms of use or rules of the road, so to speak. Try the New York Radio Message board web site: the moderator there is incredibly strict and will delete comments he doesn't like. I don't agree with it, but he's entitled to his opinion. He doesn't believe the police force should have health benefits. He doesn't want the roads plowed when it snows and he doesn't want garbage/recycling pickup. He wants the senior center and library shuttered. He wants to abolish the planning board and zoning board. In fact he wants to merge the entire town into one of the neighboring towns. The ideas may seem radical, but he has the right to express them. He wants to say to the entire town, "Felix Unger".

W/SFK would also cut all school sports and plays. The SBHS girls basketball team wouldn't have the opportunity to win the GMC tournament or make this exciting run in the state tournament. The boys and girls at XRD-S wouldn't put on their play this weekend. Everyone should sit in their house and lock their doors and be afraid. And since we all saved money we can now afford to send W/SFK's daughter to private school. No thanks, W/SFK, the community has a different vision. While you want to sit locked in your house with your S&W, others want a more vibrant COMMUNITY. One where our children have the chance to express themselves in a positive way. "FEAR me for I am W/SFK". I dare you to go to the girls basketball game or the XRD-S school play this weekend.

While I believe everyone had their right to their opinion, I also believe that there is a right and wrong way of presenting it. You can even be aggressive. But making insinuations and demeaning comments is not part of expressing a well formed opinion. And it side tracks us from the thought process and the true topic at hand...the article above. Winston, while I have lived in South Brunswick for 14 years, it has only recently come to my attention that I could attend these kind of meetings. I regret not being able to attend the meetings when the NUI was being located on RT1 by Raymond Rd (that makes traffic a bear at that intersection). As well as other issues in my area. You have to start somewhere, so here I am now. Jug handles are a major issue to me. After all, these children are not going to magically arrive on Schalks Crossing Rd...they are going to come from Ridge Rd, RT1, etc, and those traffic patterns need to be considered.

Whether you're polarized to the so called "left or right" you're part of the problem. We all need to listen to one another, try to find some common ground and if we can't, LAUGH!!!!!!!!!!!!!!!!! Although our "leaders" in Washington can't do it.
