Judge Rules Against PIACS in Lawsuit Against South Brunswick and Two Other Districts
Charter school attorney said PIACS plans to appeal decision.
The state Office of Administrative Law has ruled against the Princeton International Academy Charter School (PIACS) in their lawsuit filed against the South Brunswick, Princeton and West Windsor-Plainsboro boards of education.
Judge Lisa James-Beavers issued a ruling against the charter school late Friday afternoon. Her written decision will now be sent to acting Department of Education Commissioner Chris Cerf for review.
The suit alleged the misuse of public funds and the use of governmental positions by the three school districts to fight the opening of PIACS.
In her decision, Judge Beavers found that the three districts have "discretionary authority to perform all acts and do all things, consistent with the law and the rules of the state board, necessary for the lawful and proper conduct, equipment and maintenance of the public schools of the district."
"The discretionary authority includes activities at issue here, which were taken to protect the financial interest of the resident districts," Judge Beavers wrote in her decision.
PIACS released a statement Friday evening announcing their intent to appeal the ruling.
“We strongly disagree with the judge’s decision," said PIACS attorney Tom Abbate, of the law firm from DeCotiis, FitzPatrick & Cole. "While PIACS was disappointed in today’s decision, we are confident in our position that the expenditure of over $100,000 in public funds to oppose a charter school approved by the commissioner of education is wrong and that our position will be vindicated on appeal."
Abate said PIACS will still be pursuing their application in front of the South Brunswick zoning board for the proposed location of the school at 12 Perrine Road. PIACS has filed a new application for the charter school alone, as PIACS spokesman Parker Block said the private school proposed to share the location with PIACS has found a new location in Kingston.
"We are determined to overcome this obstacle and open the school, which will benefit students from the Princeton Regional, West Windsor-Plainsboro Regional and South Brunswick School Districts," Abate said. "As such, we are pressing forward with our plans, as the State has granted us permission to do.”
West Windsor-Plainsboro Board of Education President Hemant Marathe released a statement praising the ruling and said PIACS needs to be held accountable.
"It is a complete vindication of the school district position to represent the best interest of taxpayers and children," Marathe said. "We are very pleased with the decision and hope the commissioner will affirm this decision. We believe allowing PIACS to open is an unwise use of taxpayer money in these tough economic times. PIACS has already spent over $75,000 in grant money without completing a single application.
"The commissioner needs to examine the running of PIACS over the past two years and hold them accountable for their actions. The taxpayer in communities served by the three school districts deserve relief from the unfunded mandate of a boutique charter school."
Judge Beavers' decision may be adopted, modified or rejected by Commissioner Cerf, who by law is authorized to make the final decision on the ruling. Cerf has 45 days to take action, otherwise Judge Beavers' decision will become final.

It will be fascinating to watch the appeal process. I don't think the districts have anything to celebrate yet. The losers, again, are the kids and families who aren't able to attend the school and the taxpayers who are having to watch districts spend 100K on stopping a public school instead of using that money for instruction in other public schools. What a waste of time, money, and taxpayer dollars.

Critic Al Thinker....... This is ridiculous. What part of the judges’ decision is confusing to you? The part that the school districts have the right to inspect, approve, protect the children? If PIACS wants to "steal" tax payers’ dollars and the three school districts dollars, then it is ignorant to think they shouldn't have to be responsible to prove they are providing a safe environment..... which they have not proven. You know what the crime here is? The ignorance of PIACS coming to three successful school districts and "steal" public dollars for a private school mission. Charter Schools are wonderful.... where needed. In towns where school districts have failed to educated and prepare children. Not because someone has come along and "claimed" to have the answers to the future of the world. This is a private school for the few at the expense of the many. A school that will take 3 times the amount of per student money to cover. A school that has wasted dollars and isn't any closer to opening. And a school now that is wasting our money by filing lawsuits to re-direct the attention of their own failings. It makes everyone sick already. If you want to teach a private agenda, pay for private and open private and stop trying to steal public dollars. Especially after South Brunswick was named the 22nd Best Place to live in the U.S. by Money Magazine and one of the biggest reasons was the school district. Enough already!!!!

You know it is funny PIACS has wasted 75,000 of state funding but nobody in Trenton is questioning what that money has been spent on. Again taxpayer money right out the window.

Imagine if instead of suing and wasting our tax dollars, the PIACS organizers spent their considerable energy and resources on getting a grant, like this school district in Illinois did, that would enable all the children in the district to benefit from a language immersion program instead of only THEIR children?

Imagine if the South Brunswick BOE really cared about diversity and advancing educational options rather than protecting the status quo and the NJEA agenda...they wouldn't be wasting our tax dollars suing PIACS. How many gym teachers could be employed rather than paying a politically connected lawyer?

Winston........ That may be the CRAZIEST response yet!!! What the heck does this have to do with diversity? Even PIACS hasn't made this a diversity issue. Their platform is that the world economic development has led to worldwide trading and dual language understanding is important to be a worldwide force. Anyone that can read through that knows that has NOTHING to do with diversity. All the people out there that's making our school districts the "Center of the Universe" of the NJEA are just as bad as PIACS. Let's see what element of the process can we attack so that our point is valid. If we see a sidewalk with a dried up piece of chewing gum, it's the platform for the outlaw of gum in our town because you see, gum is a problem. Where are the schools failing? What? Because one group says so? So Money Magazine is crazy and every measuring stick in regards to successful education is crazy? You know what's crazy? Taking three successful school districts and THREATENING that success by taking money away from them to benefit 30 kids in each town and destroying the education of thousands. And no one try to pull a "civil rights" style agenda back on that because no one is being denied an education. We use to call what PIACS is trying to do a "private school". PIACS is the only one taking advantage of loop holes of what Charter Schools should be about. Would love to see how much money these folks make from their "helpful mission".

............oh, and BTW............ someone help me with the whole "injustice argument". Where I grew up, it was worse taking money from a large group that shared it and said, "OK, only a few of you can go and the others aren't welcome"........... Isn't that EXACTLY what PIACS and all these Charter Schools are about? Selecting those that are most "desirable". Again, I'm a fan of Charter Schools in school districts that have walked away from a successful agenda of teach and success on a National Level. No one can ever say that's what's needed in South Brunswick, West Windsor, and Princeton!!!

So the ultimate decision will be left to Czar Cerf (a pro charter ideologue) who can impose as many charter schools on a district as he sees fit to do and who can even negate contracts mutually agreed upon by the school district and the local teachers' associations. I don't think that charter schools have proved useful even in the big city school systems. The media hype the few successful city charter schools while ignoring the majority of charters that do no better than the traditional public schools and the abject charter failures. The charter schools that close down in the middle of the year due to some kind of malfeasance or nonfeasance are ignored. When a charter school abruptly closes down, the children must immediately be absorbed into the traditional public schools; this is a massive disruption for the kids and the traditional school system. The residents of a school district should have some say or vote about whether a charter school will be placed in their district. The charter school board is unelected. The chutzpah, hubris, arrogance and sense of entitlement of the PIACS founders is truly breathtaking.

He is very well paid for this service, so argue at your own delight as he will always take the "opposite" of the majority. While your posts are very well written and tell a good story, his are more entertaining. His daughter benefits from the SB education system and he has no desire to send her to a Charter School. He knows this is a hot button topic and he enjoys getting under your skin.

His job is to post entries that support ultra left wing views and blind support for the democratic party and unions. Upon reading his posts no one can really take him seriously. People, I don't really care whether a replier is real or a figment of their own imagination. Every time someone makes any type of talking points, it's an opportunity to point out the difference of opinion. Quite frankly, we don't know who's real here either. All we know as a fact is PIACS mission is fake and their potential entry into this area with this school serves no helpful benefit vs. what these "chosen few" could get at a private school if their parents really thought the investment was worthwhile. If you want a private school education, go for it on your coin. PIACS who insist their "for the children" have no problem watching thousands of dollars be spent on their own lawsuits and dragging these school districts into the forced spending. They lost their suit, but choose to appeal. Stop it already. Parker Block and his band of the "chosen ones" is a fraud in what's in it for him and will keep on trying to create better fantasy than Alfred Hitchcock. He will try to prove the movement against PIACS is being created and funded by the school boards when it's the citizens of these districts that don't want him stealing their money from their terrific educational system that's already financially not in the greatest place because of state cuts.
